Privacy Policy

The short version: we collect the contact details and answers you give us so we can follow up about our services. We never sell your information for money and we never resell enquiries to other agencies. We do use the Meta Pixel for advertising, which several state laws treat as "sharing" or "targeted advertising" — you can switch that off any time on our Your Privacy Choices page, and we honour Global Privacy Control automatically.

1. Who we are

Crescendo Marketing ("we", "us") provides lead generation and AI appointment setting for service businesses. We are based in Chattanooga, Tennessee, and work with clients across the United States and Canada. You can reach us any time at juan@crescendomarketing.biz.

This policy covers crescendomarketing.biz and the landing pages we run at that domain. It does not cover our clients' own websites, or the Facebook and Instagram pages we operate on their behalf — those are governed by our clients' policies and by Meta's.

2. What we collect

Information you give us

When you fill in a form or quiz on this site, we collect the details you enter — typically your name, phone number, email address, business name, and your answers to the qualifying questions (how you currently follow up with leads, what a customer is worth to you, approximate monthly revenue, what marketing assets you already have, and your ad budget).

Information collected automatically

Like most websites, we log basic technical information: IP address, browser and device type, referring page, and which pages you viewed. We use this for analytics and to keep the site working.

Information from advertising platforms

If you reply to one of our ads on Facebook or Instagram, Meta passes us the message and the profile name attached to it so we can respond.

3. How we use it

  • To reply to you and follow up about working together
  • To prepare a quote or a plan specific to your business
  • To deliver our services if you become a client
  • To measure which ads and pages actually produce enquiries
  • To meet our legal and accounting obligations

We do not use your information to make automated decisions that have a legal effect on you.

4. Calls, texts and email

When you give us your phone number through a form on this site, you agree that we may contact you about your enquiry by phone call, text message, and email. We text first rather than calling out of the blue.

By submitting a form with your phone number you give prior express written consent to receive calls and text messages from Crescendo Marketing at that number, including messages sent using automated technology. Consent is not a condition of purchasing any goods or services, and you can still reach us by email if you would rather not receive texts.

Message frequency varies and depends on your enquiry. Message and data rates may apply. Reply STOP to any text to opt out, or HELP for help. We honour opt-outs immediately. Carriers are not liable for delayed or undelivered messages.

You can unsubscribe from marketing emails using the link in any email, or by writing to juan@crescendomarketing.biz. Some states — including Florida and Oklahoma — restrict the hours during which marketing calls and texts may be sent; we send during normal business hours in your local time zone.

5. Who we share it with

We do not sell your personal information, and we do not resell enquiries to other agencies.

We share information only with the service providers we use to run the business, and only so they can perform that work for us:

  • Customer relationship management — to store your details and our conversation history
  • Hosting and application infrastructure — to run this website and the systems that receive form submissions
  • Internal messaging and file storage — so our team is notified about your enquiry
  • Analytics and advertising platforms — including Meta and Google, as described below
  • Email and calendar providers — to correspond with you and schedule calls

We may also disclose information if we are legally required to, or to protect our rights, and we would transfer it as part of a sale or merger of the business.

6. Cookies, analytics and advertising

We use cookies and similar technologies for analytics and advertising measurement, including the Meta Pixel and Google Analytics. These help us understand which ads and pages lead to enquiries, and allow us to show ads to people who have visited the site.

You can block or delete cookies in your browser settings. You can control ad personalisation directly with Meta and Google. Blocking cookies may affect how parts of the site work.

7. How long we keep it

We keep enquiry records for as long as needed to follow up and, if you become a client, for the length of the engagement plus the period our accounting and tax obligations require. If you ask us to delete your information and we have no legal reason to keep it, we will.

We disclose these categories to the service-provider types listed in section 5. We do not collect sensitive personal information as that term is defined by state privacy laws — no government identifiers, financial account credentials, precise geolocation, health information, biometrics, racial or ethnic origin, religion, union membership, sexual orientation, or the contents of your private messages. We do not use or disclose sensitive personal information for inferring characteristics. We do not knowingly process the personal information of anyone under 18, and we do not sell or share the personal information of minors under 16.

We do not collect "consumer health data" as defined by the Washington My Health My Data Act, the Nevada health data law, or comparable laws. We market to business owners; we do not receive our clients' patient or customer health records.

9. Selling, sharing and targeted advertising

We do not sell your personal information for money, and we never resell enquiries to other agencies.

We do, however, use the Meta Pixel so we can measure our advertising and show ads to people who have visited our site. Several state privacy laws define that activity as a "sale" or as "sharing" for cross-context behavioural advertising or "targeted advertising", even where no money changes hands. We are telling you that plainly rather than relying on a narrow reading of the word "sell".

You have the right to opt out. There are two ways, and both work:

  • Your Privacy Choices — a switch on our site that turns off advertising and analytics tags for your browser and clears the associated cookies.
  • Global Privacy Control — if your browser or extension sends a GPC signal, we treat it as a valid opt-out automatically. You do not need to tell us anything.

10. Your rights

Depending on the state you live in, you may have some or all of the following rights. We extend every one of them to all US residents regardless of state, so you do not need to work out which law applies to you:

  • Know / access — what personal information we hold about you, where we got it, why we have it, and who we disclosed it to
  • Portability — a copy in a portable, readily usable format
  • Correct — fix information that is inaccurate
  • Delete — have your personal information deleted
  • Opt out — of sale, sharing, targeted advertising, and profiling that produces legal or similarly significant effects (we do not carry out such profiling)
  • Limit use of sensitive personal information — we do not collect any, so there is nothing to limit
  • Non-discrimination — we will not deny you service, charge you a different price, or give you a lower quality of service for exercising any of these rights

How to make a request

Email juan@crescendomarketing.biz with the subject line "Privacy Request", or use the form on our contact page. Tell us which right you are exercising.

We will verify your identity by matching the details you give us against what we hold — usually the email address or phone number you gave us. For a deletion or access request we may ask for one additional matching detail. We will not ask you for more information than is necessary, and we will not use it for anything else.

Authorised agents: you may use an authorised agent to make a request. We will ask for written permission signed by you, and we may ask to verify your identity directly.

Timing: we will confirm receipt within 10 business days and respond substantively within 45 days. If we need longer we will tell you why and take up to 45 additional days. There is no charge unless a request is manifestly unfounded or excessive, in which case we will tell you before doing anything.

If we say no — your right to appeal

If we decline your request, we will tell you why in writing. You may appeal by replying to that decision or emailing juan@crescendomarketing.biz with the subject line "Privacy Appeal". We will decide the appeal within 45 days and give you a written explanation of the reasons. If we deny the appeal, we will give you a way to contact your state Attorney General to lodge a complaint.

11. State-specific notes

California. This policy is our notice at collection. The categories we collect, our sources, purposes, and disclosure categories are in section 8; retention is in section 7. We share personal information for cross-context behavioural advertising as described in section 9 and you may opt out there. We do not sell personal information for money and we do not use or disclose sensitive personal information beyond what is permitted without a right to limit. Under California's "Shine the Light" law you may request details of any disclosure to third parties for their own direct marketing; we make no such disclosures.

Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Delaware, New Jersey, Nebraska, New Hampshire, Minnesota, Maryland, Indiana, Iowa, Kentucky, Rhode Island, Tennessee and Utah. You have the rights listed in section 10, including the right to opt out of targeted advertising, and the right to appeal a refusal as described above. Colorado, Connecticut, Texas, Montana, Oregon, Delaware and New Jersey residents: we honour Global Privacy Control. Minnesota residents may also ask us to review the data used in any profiling decision; we do not carry out profiling that produces legal or similarly significant effects.

Nevada. Nevada law gives you the right to tell us not to sell certain covered information. We do not sell covered information, but you may submit a verified request to juan@crescendomarketing.biz.

All other states. If your state gives you a right not listed here, tell us and we will honour it. Where a state law we are not strictly subject to would give you a stronger right, we will still generally honour it rather than argue about thresholds.

12. Security

We use reputable providers and take reasonable measures to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

13. Children

This site is intended for business owners. We do not knowingly collect information from anyone under 18. If you believe a child has given us information, contact us and we will delete it.

14. Changes

If we change this policy we will update the date at the top of this page. Material changes will be made clear on the site.
